The Oath-Keeper Pleaded Guilty
Joshua James, who ran the Alabama chapter of the far-right Oath Keepers, also pleaded guilty to obstructing the official process. He faces up to nine years in prison and a fine of up to $300,000, according to the agreement, which was read out at Wednesday’s hearing.
The development is a significant step forward for prosecutors who brought the ambitious case into the Jan. 6 investigation with some of the most serious charges. Other Capitol Riot defendants with ties to Oathkeepers who have not been charged with sedition have already agreed to work together.
James, a Purple Heart winner in the military, was originally arrested in March last year for his alleged involvement in the riots.
During the hearing, James admitted that he and other members of the Oath Keepers planned to storm the Capitol to stop the confirmation of the 2020 Electoral College election.
“Do you agree that by taking such action you attempted to influence the conduct of the United States government or to retaliate against the United States government?” Federal Judge Amit Mehta asked during the hearing.
“Yes sir,” James replied.
What Was The Trial?
An FBI agent previously told the court that James had taken Roger Stone, a longtime friend of former President Donald Trump, in a golf cart the day before January 6, 2021 in Washington. Stone was only charged with “no crime”.
Per his plea agreement, James met with members of the Oath Keepers, including founder Stewart Rhodes, in November 2020.
The alleged plan called for members of the Rhodes-led Oath Keepers to use “any means necessary” to prevent Joe Biden from becoming president, including using deadly force if anyone tried to remove Trump from the White House Force.
In the indictment charging James and other sworn inmates with seditious conspiracy, prosecutors alleged members of the group organized to disrupt congressional certification of the 2020 election and “violently resist the legal transfer of power from the President” by hiding weapons and ammunition at a Virginia hotel as part of a rapid reaction force and continues to plan an attack after January 6th.
The indictment also alleges that after the riots, while other sworn officers were planning future actions, James sent a message to a staff member: “After that…if nothing happens…it’s war…Civil War 2.0.”
On January 6, James rushed to the riots in a golf cart. Per the plea agreement, he and two other presumptive jurors, Roberto Minuta and Jonathan Walden, entered the Capitol and occasionally fought with police.
After the riot, James admitted that he, Rhodes, and other members of the Oath Keepers took precautions to hide their identities, including changing their appearance and using cell phones.
James also admitted that he made “multiple trips” with Rhodes to purchase thousands of dollars worth of firearms, ammunition, and tactical gear.
