Jonathan Ginder Sentenced For Fatal A1 Crash Which Killed Partner
Ginder did not see a black Mazda car in the outer lane when she arrived just before noon on 19th November.
His BMW motorcycle made contact with the rear door of the Mazda and then hit the reserve fund.
He suffered a fractured left tibia and knee ligaments that immobilized him for six months.
The Mazda had driven at 70 mph. The fatal crash was captured on the dashcam of a pickup truck behind him.
Ginder joined the Army in 1976, went to Sandhurst, and served in the Royal Artillery.
He served in Northern Ireland and became a Major in 1992 when he was honorably released.
What Was The Trial?
He appeared in St. Alban Crown Court after pleading guilty to causing death for reckless driving.
Ginder was serving a ten-month sentence, which was suspended for two years.
You must adhere to a four-month curfew between 8 p.m. and 6 a.m. and you are banned from driving for one year.
Prosecutor Will Noble said, “Prosecutors say they made some observations but did not see the Mazda in lane two.”
“He was walking through hallway one every second and didn’t have enough time to move to hallway two.”
“If he had stopped he would have seen the Mazda and not have moved.”
Prosecutors say it was not dangerous driving. It left the slipway on track two in just 3.2 seconds.
The court heard that Ms. Malone had been Ginder’s girlfriend for three years.
Trevor Burke QC, who defended, said Ginder was a man of good character with no criminal record.
Mr. Burke said: “He has not ridden a motorcycle since the incident and does not intend to ride a motorcycle again.”
“This incident was short and tragic. It was not preceded by stubborn or terrible conduct.”
“When he arrived at A1M, he took on the real shoulder role.”
The victim was his companion, he loved her and she loved him. They were determined to spend the rest of their lives together. She had embraced her passion for motorcycles.
“She passed her exam and bought her bike. They went on a motorcycle vacation together.”
“She was a dedicated nurse in Addenbrooke.” He had many friends and fans.
“It was obvious that she was very popular, especially with the accused.”
Judge Michael QC Kay said: “It was a tragedy. There were dire consequences for the defendants and Ria Malone’s family during the trial. There is nothing I can do to help matters.”
“No one intended for this. No one wanted this to happen. In all respects, it is a terrible tragedy.”
