Nicholas Gutierrez is a Diamond Barman who was released Thursday night after he was arrested on suspicion of the attempted murder of law enforcement officers in a crash that injured 25 recruits during Wednesday’s practice in South Whittier.

The recruits were running in four columns, escorted by instructors and two cars with black-and-white radios when around 6:30 a.m. a Honda CRV hit the group Wednesday near the sheriff’s STARS Center Academy on the 10600 block of Mills Avenue, authorities said.
As the group ran north on Mills Avenue, a vehicle approached at 30 to 40 miles per hour, witnesses said. It got on the wrong side of the road and rammed the recruits. Drivers at the front of the formation could dodge before the SUV hits others and crashes into a utility pole, authorities said.
Villanueva said at a news conference on Wednesday that there were no tire tracks at the scene. The sheriff said the driver remained in the vehicle after the accident and those at the scene initially had trouble getting him out.
“As far as I know, he was in the vehicle with his foot still on the accelerator,” he said.
Released From Jail
Prison records show Nicholas Joseph Gutierrez was released at 9:49 p.m. and his initial arrest on Wednesday was classified as a prison sentence. The records cite California Penal Code 849(b)(1), which allows police to release arrested individuals without charge if there are insufficient grounds to report them.
Investigators are continuing to develop the case against Gutierrez, but legally they can’t hold a suspect in custody for more than 48 hours without referring the case to prosecutors, Sgt. Gerardo Magos, spokesman for the Los Angeles County Sheriff’s Department.
Once investigators create a case, they plan to arrest Gutierrez and submit the case to the Los Angeles County Attorney’s Office, Magos said.
